Situation in Syria<\/strong><\/p>\n<p>Excellencies,\n<\/p>\n<p class=\"MsoNormal\">\nFIDH and its Syrian member and partner organisations are<br \/>\ndeeply concerned about the ongoing repression in Syria, the increasing level of<br \/>\nviolence reported on a national scale, the deterioration of the humanitarian<br \/>\ncrisis in some targeted areas, and the blackout on the human rights violations<br \/>\ncommitted by the Syrian authorities, as the latter continue to refuse<br \/>\nterritorial access to independent human rights NGOs, foreign journalists, and<br \/>\nUN bodies such as the Fact finding mission on the situation in Syria mandated<br \/>\nby the Human Rights Council of the United Nations. <\/p>\n<p>These crimes may amount to crimes against humanity, yet, members of the UN Security<br \/>\nCouncil have so far failed to a react in line with their mandate under chapter<br \/>\nVII of the UN Charter and in application of their Responsibility to Protect.<\/p>\n<p>Since the beginning of the uprising in Syria in March 2011, FIDH and its Syrian<br \/>\nmember and partner organisations have received a considerable amount of<br \/>\ninformation on the commission of extra-judicial killings, the systematic use of<br \/>\nviolence by governmental forces, mass arrests, abductions, enforced<br \/>\ndisappearances and detention of civilians, acts of torture, degrading or<br \/>\ninhumane treatments, repression of the freedom of peaceful assembly and<br \/>\nviolations of the right to freedom of information, in particular by targeting<br \/>\nthe media and human rights defenders, military operations and actions<br \/>\nundertaken to besiege cities, and practices amounting to collective punishment<br \/>\nand to the deprivation of food, water, and medical supplies, as well as the<br \/>\nrestriction and denial of access to hospitals. A compilation of this<br \/>\ninformation released last week, has been sent to your attention.<\/p>\n<p>The UN High Commissioner for Human rights, the UN Human Rights Council, and the<br \/>\nUN Secretary General have all called the Syrian authorities to put an end to<br \/>\nthe repression, but this has not had an&nbsp; impact on the situation. On July<br \/>\n22, United Nations watchdogs, Francis Deng, the UN Special Adviser of the<br \/>\nSecretary General on the prevention of Genocide and Edward Luck, the Special<br \/>\nAdviser on the Responsibility to Protect alerted that crimes against humanity<br \/>\nmay have been committed and continue to be committed.<\/p>\n<p>Yet, in spite of these repeated calls, the repression continues to unfold<br \/>\nbefore our eyes. Over the past few days, between July 31st and August 1st , the<br \/>\nrepression in Syria reached a higher degree of gravity. In the city of Hama alone,<br \/>\non July 31st, more than 100 people were killed as the Syrian authorities<br \/>\nreportedly used heavy artillery, such as tanks, to bomb houses and civil<br \/>\ninfrastructures. On August 1st, the first day of Ramadan, at least 41 civilans<br \/>\ndied in several cities and villages across Syria including Hama, Arbeen,<br \/>\nMoadamieh, Daraa, Al-Bokamal, Der Al Zour, and Homs. The use of lethal weapons<br \/>\nby Syrian forces and raids of arbitrary arrests as well as with further<br \/>\nallegations of torture were also reported.<\/p>\n<p>As the death toll since the beginning of the uprising comes close to 2000<br \/>\ndeaths, the Syrian authorities continue to open fire on the civilian<br \/>\npopulation, while several villages and cities across Syria are still besieged<br \/>\nby the Syrian army, causing the civilian population to remain in urgent need of<br \/>\nfood and medical care. The nature of the violations under way allow us to<br \/>\nconclude that crimes against humanity under the jurisdiction of the<br \/>\nInternational Criminal court are being perpetrated by the Syrian authorities.<\/p>\n<p>We thus call upon members of the United Nations Security Council to intervene<br \/>\nurgently in application of Chapter VII of the UN Charter, as well as of their<br \/>\nResponsibility to Protect, which world leaders affirmed at the World Summit of<br \/>\n2005, in order to prevent the commission of further crimes, protect the<br \/>\ncivilian population and prosecute those responsible, in adopting a resolution<br \/>\nwhich, inter alia,\n<\/p>\n<ul style=\"margin-top: 0in\">\n<li class=\"MsoNormal\">Calls<br \/>\n\tupon the Syrian government to:<\/li>\n<\/ul>\n<ul style=\"margin-top: 0in\">\n<li class=\"MsoNormal\">Immediately<br \/>\n\tput an end to the use of force and violence against the civilian<br \/>\n\tpopulation, and to put an end to the perpetration of human rights<br \/>\n\tviolations and violations of international humanitarian law;<\/li>\n<li class=\"MsoNormal\">Release<br \/>\n\tall the individuals arrested and detained since the beginning of the<br \/>\n\tuprising;<\/li>\n<li class=\"MsoNormal\">Respect<br \/>\n\tin all circumstances the right to peaceful assembly;<\/li>\n<li class=\"MsoNormal\">Ensure<br \/>\n\tthe safe passage of humanitarian and medical supplies, and humanitarian<br \/>\n\tagencies and workers, into the country;<\/li>\n<li class=\"MsoNormal\">Enable<br \/>\n\tunrestricted access, including to all places of detention, to Syrian and<br \/>\n\tinternational human rights monitors, notably the mission dispatched by the<br \/>\n\tOffice of the High Commissioner for Human Rights in application of the UN<br \/>\n\tHuman Rights Council resolution A\/HRC\/RES\/S-16\/1 of 29 April 2011;<\/li>\n<\/ul>\n<ul style=\"margin-top: 0in\">\n<li class=\"MsoNormal\">Decides<br \/>\n\tto refer the situation in Syria to the Prosecutor of the International<br \/>\n\tCriminal Court, in application of Article 13b of the Rome Statute;<\/li>\n<li class=\"MsoNormal\">Establishes<br \/>\n\tan embargo to prevent the direct or indirect supply, sale or transfer of<br \/>\n\tarms and related material to Syria or through Syrian officials;<\/li>\n<li class=\"MsoNormal\">Establishes<br \/>\n\ta list of individuals and authorities responsible for these violations and<br \/>\n\ttheir submission to a travel ban and the freezing of their financial<br \/>\n\tassets and economic resources.<\/li>\n<\/ul>\n<p class=\"MsoNormal\">\n<br \/>\nThanking you for your attention, we trust that you will react promptly.
