{"id":301,"date":"2011-07-20T00:00:00","date_gmt":"2011-07-20T00:00:00","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"-0001-11-30T00:00:00","slug":"","status":"publish","type":"post","link":"https:\/\/dchrs.org\/?p=301","title":{"rendered":"Arbitrary detention and judicial harassment against Mr. Mohamed Najati Tayara\u00fe"},"content":{"rendered":"<p class=\"MsoNormal\">\n<strong><span>URGENT<br \/>\nAPPEAL &#8211; THE OBSERVATORY<\/span><\/strong>\n<\/p>\n<p class=\"MsoNormal\">\n<strong><span>SYR 010<br \/>\n\/ 0711 \/ OBS 102<\/span><\/strong>\n<\/p>\n<p class=\"MsoNormal\">\n<span>Arbitrary<br \/>\ndetention \/ Judicial harassment<\/span>\n<\/p>\n<p><a href=\"File\/Statements\/2011\/07-20-2011ArbitraryDetentionAgainstMrMohamedNajatiTayara.pdf\">Arbitrary detention and judicial harassment against Mr. Mohamed Najati Tayara<\/a><\/p>\n<p class=\"MsoNormal\">\n<strong><span>Syria<\/span><\/strong>\n<\/p>\n<p class=\"MsoNormal\">\n<span>July 20,<br \/>\n2011<strong>&nbsp;<\/strong><\/span>\n<\/p>\n<p class=\"MsoNormal\">\n<span>The<br \/>\nObservatory for the Protection of Human Rights Defenders, a joint programme of<br \/>\nthe International Federation for Human Rights (FIDH) and the World Organisation<br \/>\nAgainst Torture (OMCT), requests your urgent intervention in the following<br \/>\nsituation in <strong>Syria<\/strong>.<\/span>\n<\/p>\n<p class=\"MsoNormal\">\n<strong><span>Description<br \/>\nof the situation: <\/span><\/strong>\n<\/p>\n<p class=\"MsoNormal\">\n<span>The<br \/>\nObservatory has been informed by reliable sources about the arbitrary detention<br \/>\nand judicial harassment against Mr.<strong> Mohamed Najati Tayara<\/strong>, a human<br \/>\nrights activist and former member of the Syrian Association for Human Rights. <\/span>\n<\/p>\n<p class=\"MsoNormal\">\n<span>According<br \/>\nto the information received, on May 12, 2011, Mr. Tayara was arrested by three<br \/>\narmed members of the political security near Khaled Bin Al-Walid Mosque in Homs<br \/>\non accusation of having denounced &nbsp;human rights violations committed in<br \/>\nthe context of the violent repression of peaceful protests in the country. On<br \/>\nMay 14, 2011, he was remanded in custody and transferred to the Central Prison<br \/>\nof Homs on charges of &ldquo;spreading false information&rdquo; and &ldquo;weakening national<br \/>\nsentiments&rdquo;, pursuant to Article 286 of the Syrian Criminal Code. Despite the<br \/>\nfirst General Amnesty issued by the Syrian President Bashar Al-Assad on May 31,<br \/>\n2011, the referral judge refused to release Mr. Tayara. Then, following the<br \/>\nSecond General Amnesty on June 21, 2011, the referral judge decided to drop all<br \/>\ncharges against Mr. Tayara. Yet, the Court Prosecutor appealed this decision<br \/>\nand Mr. Tayara currently remains in detention in the Central Prison of Homs,<br \/>\nawaiting decision from the Court of Cassation in Damascus. <\/span>\n<\/p>\n<p class=\"MsoNormal\">\n<span>Initially,<br \/>\nMr. Tayara was detained in a dormitory with 350 other detainees, without<br \/>\nappropriate sanitary facilities or medical services. On May 20, 2011, Mr.<br \/>\nTayara started a hunger strike along with other detainees to protest against<br \/>\ntheir detention and was subsequently ordered into solitary confinement.<br \/>\nAccording to the information received, Mr. Tayara would be in a bad health<br \/>\ncondition. Since his arrest, he has only been allowed weekly visits by his wife<br \/>\nand lawyer.<\/span>\n<\/p>\n<p class=\"MsoNormal\">\n<span>The<br \/>\nObservatory condemns the continued detention and judicial harassment against<br \/>\nMr. Tayara, which seem to merely aim at sanctioning his human rights activities<br \/>\nand urges the authorities to release him immediately and unconditionally.&nbsp;<\/span>\n<\/p>\n<p class=\"MsoNormal\">\n<strong><span>Actions<br \/>\nrequested:<\/span><\/strong>\n<\/p>\n<p class=\"MsoNormal\">\n<span>Please<br \/>\nwrite to the Syrian authorities, urging them to: <\/span>\n<\/p>\n<p class=\"MsoNormal\">\n<span>i.<br \/>\nGuarantee in all circumstances the physical and psychological integrity of Mr.<br \/>\nMohamed Najati Tayara, as well as of all human rights defenders in Syria, and<br \/>\nensure in all circumstances that Syrian human rights defenders are able to<br \/>\ncarry out their work without unjustified hindrances;<\/span>\n<\/p>\n<p class=\"MsoNormal\">\n<span>ii.<\/span><span> <\/span><span>Ensure Mr.<br \/>\nMohamed Najati Tayara&#8217;s access to an appropriate medical treatment;<\/span>\n<\/p>\n<p class=\"MsoNormal\">\n<span>iii. Ensure<br \/>\nthe immediate and unconditionally release of Mr. Mohamed Najati Tayara since<br \/>\nhis detention is arbitrary and only aims at sanctioning his human rights<br \/>\nactivities;<\/span>\n<\/p>\n<p class=\"MsoNormal\">\n<span>iv.<\/span><span> <\/span><span>Put an end<br \/>\nto any act of harassment, including at the judicial level, against Mr. Mohamed<br \/>\nNajati Tayara and more generally against all human rights defenders in Syria; <\/span>&nbsp;\n<\/p>\n<p class=\"MsoNormal\">\n<span>v.<\/span><span> <\/span><span>Comply with<br \/>\nall the provisions of the United Nations Declaration on Human Rights Defenders,<br \/>\nin particular with its Article 1, which provides that &ldquo;everyone has the right,<br \/>\nindividually and in association with others, to promote and to strive for the<br \/>\nprotection and realization of human rights and fundamental freedoms at the<br \/>\nnational and international levels&rdquo;, its Article 5 (c), which states that &ldquo;for<br \/>\nthe purpose of promoting and protecting human rights and fundamental freedoms,<br \/>\neveryone has the right, individually and in association with others, at<br \/>\nnational and international levels (&#8230;) to communicate with non-governmental or<br \/>\nintergovernmental organizations&rdquo;, its Article 6 (b) regarding the right &ldquo;to<br \/>\nfreely publish, impart or disseminate to others views, information and<br \/>\nknowledge on all human rights and fundamental freedoms&rdquo;, as well as with<br \/>\nArticle 12.2 &ldquo;the State shall take all necessary measures to ensure the<br \/>\nprotection by the competent authorities of everyone, individually and in<br \/>\nassociation with others, against any violence, threats, retaliation, de facto<br \/>\nor de jure adverse discrimination, pressure or any other arbitrary action as a<br \/>\nconsequence of his or her legitimate exercise of the rights referred to in the<br \/>\npresent Declaration&rdquo;; <\/span>\n<\/p>\n<p class=\"MsoNormal\">\n<span>vi.
