\nThe
\nObservatory for the Protection of Human Rights Defenders, a joint programme of
\nthe International Federation for Human Rights (FIDH) and the World Organisation
\nAgainst Torture (OMCT), requests your urgent intervention in the following
\nsituation in Syria<\/strong>.<\/span>\n<\/p>\n

\nDescription
\nof the situation: <\/span><\/strong>\n<\/p>\n

\nThe
\nObservatory has been informed by reliable sources about the arbitrary detention
\nand judicial harassment against Mr. Mohamed Najati Tayara<\/strong>, a human
\nrights activist and former member of the Syrian Association for Human Rights. <\/span>\n<\/p>\n

\nAccording
\nto the information received, on May 12, 2011, Mr. Tayara was arrested by three
\narmed members of the political security near Khaled Bin Al-Walid Mosque in Homs
\non accusation of having denounced  human rights violations committed in
\nthe context of the violent repression of peaceful protests in the country. On
\nMay 14, 2011, he was remanded in custody and transferred to the Central Prison
\nof Homs on charges of “spreading false information” and “weakening national
\nsentiments”, pursuant to Article 286 of the Syrian Criminal Code. Despite the
\nfirst General Amnesty issued by the Syrian President Bashar Al-Assad on May 31,
\n2011, the referral judge refused to release Mr. Tayara. Then, following the
\nSecond General Amnesty on June 21, 2011, the referral judge decided to drop all
\ncharges against Mr. Tayara. Yet, the Court Prosecutor appealed this decision
\nand Mr. Tayara currently remains in detention in the Central Prison of Homs,
\nawaiting decision from the Court of Cassation in Damascus. <\/span>\n<\/p>\n

\nInitially,
\nMr. Tayara was detained in a dormitory with 350 other detainees, without
\nappropriate sanitary facilities or medical services. On May 20, 2011, Mr.
\nTayara started a hunger strike along with other detainees to protest against
\ntheir detention and was subsequently ordered into solitary confinement.
\nAccording to the information received, Mr. Tayara would be in a bad health
\ncondition. Since his arrest, he has only been allowed weekly visits by his wife
\nand lawyer.<\/span>\n<\/p>\n

\nThe
\nObservatory condemns the continued detention and judicial harassment against
\nMr. Tayara, which seem to merely aim at sanctioning his human rights activities
\nand urges the authorities to release him immediately and unconditionally. <\/span>\n<\/p>\n

\nActions
\nrequested:<\/span><\/strong>\n<\/p>\n

\nPlease
\nwrite to the Syrian authorities, urging them to: <\/span>\n<\/p>\n

\ni.
\nGuarantee in all circumstances the physical and psychological integrity of Mr.
\nMohamed Najati Tayara, as well as of all human rights defenders in Syria, and
\nensure in all circumstances that Syrian human rights defenders are able to
\ncarry out their work without unjustified hindrances;<\/span>\n<\/p>\n

\nii.<\/span> <\/span>Ensure Mr.
\nMohamed Najati Tayara’s access to an appropriate medical treatment;<\/span>\n<\/p>\n

\niii. Ensure
\nthe immediate and unconditionally release of Mr. Mohamed Najati Tayara since
\nhis detention is arbitrary and only aims at sanctioning his human rights
\nactivities;<\/span>\n<\/p>\n

\niv.<\/span> <\/span>Put an end
\nto any act of harassment, including at the judicial level, against Mr. Mohamed
\nNajati Tayara and more generally against all human rights defenders in Syria; <\/span> \n<\/p>\n

\nv.<\/span> <\/span>Comply with
\nall the provisions of the United Nations Declaration on Human Rights Defenders,
\nin particular with its Article 1, which provides that “everyone has the right,
\nindividually and in association with others, to promote and to strive for the
\nprotection and realization of human rights and fundamental freedoms at the
\nnational and international levels”, its Article 5 (c), which states that “for
\nthe purpose of promoting and protecting human rights and fundamental freedoms,
\neveryone has the right, individually and in association with others, at
\nnational and international levels (…) to communicate with non-governmental or
\nintergovernmental organizations”, its Article 6 (b) regarding the right “to
\nfreely publish, impart or disseminate to others views, information and
\nknowledge on all human rights and fundamental freedoms”, as well as with
\nArticle 12.2 “the State shall take all necessary measures to ensure the
\nprotection by the competent authorities of everyone, individually and in
\nassociation with others, against any violence, threats, retaliation, de facto
\nor de jure adverse discrimination, pressure or any other arbitrary action as a
\nconsequence of his or her legitimate exercise of the rights referred to in the
\npresent Declaration”; <\/span>\n<\/p>\n

\nvi. Ensure
\nin all circumstances respect for human rights and fundamental freedoms in
\naccordance with international human rights standards and international
\ninstruments ratified by the Syrian Arab Republic.  <\/span>\n<\/p>\n
